Enforcing an Existing Child Maintenance Order

An unpaid child maintenance order requires organised enforcement through the competent court. The first task is to identify exactly what the order requires, when each payment fell due and what has already been paid. A demand for arrears should follow the order’s terms and supporting evidence rather than an estimated lump sum.

A final decree, an interim maintenance order and a private agreement are different legal instruments. The available procedure depends on which one exists, the applicable provincial law and the case record. If no enforceable order has yet been obtained, advice on starting or progressing a maintenance claim may be needed before execution can be pursued.

Prepare the Decree and Arrears Schedule

Obtain certified copies of the relevant judgment, decree and later orders affecting the amount or payment schedule. Record the court, case number, parties and dates. Check for an appeal, stay, variation or recorded settlement rather than assuming that the original figure remains the only operative direction.

Prepare a month-by-month schedule showing the amount due, due date, amount received, payment date and balance. Identify separately any annual increase, school expense or medical expense expressly covered by the order. Explain the basis of each item and attach supporting receipts where needed.

Credit payments accurately, including deposits received through court or an agreed banking channel. Keep bank statements, transfer references, court receipts and relevant correspondence. Disputed cash payments should be identified honestly and supported by whatever evidence exists. The schedule should make it easy for the court to see the calculation and resolve objections.

File in the Competent Executing Court

Section 13 of the Family Courts Act addresses enforcement of decrees. The applicable version of the Act and local procedure must be checked for the relevant jurisdiction. A lawyer should identify the competent executing court and whether any transfer or other direction is required.

An execution application should identify the decree, the unpaid obligation and the relief requested. Supply the judgment debtor’s available service details and reliable information relevant to lawful recovery. Do not include speculative asset allegations or obtain financial information through unauthorised access.

Keep the filing receipt and follow the court’s directions for service, supporting documents and hearings. If the other party disputes the calculation, respond with a revised reconciliation showing the source of every figure. Execution should implement the order rather than introduce unrelated claims that require separate adjudication.

Recovery Measures and Continuing Payments

The court determines which enforcement measures are legally available and justified. No particular measure, such as salary recovery, attachment or coercive action, should be promised automatically. Requests must comply with the governing law, notice requirements and judicial directions.

An application concerning arrears does not remove the need to track future instalments. Maintain a running ledger and record each payment consistently. Ask counsel how newly accrued amounts should be brought before the court under the applicable procedure.

If the child’s needs or other relevant circumstances have changed, consider whether a separate variation or enhancement application is appropriate. An enforcement calculation should not unilaterally substitute a higher monthly amount for the amount ordered. Similarly, a payer should not treat changed circumstances as permission to stop complying without a legally effective order.

Settlements, Overseas Parties and Case Follow-Up

Any proposed repayment arrangement should distinguish arrears from current monthly maintenance. Specify payment dates, the account or court channel, treatment of default and whether the arrangement needs to be recorded by the court. Do not sign a broad release without understanding its effect on the child’s interests and outstanding obligations.

Where a party is overseas, identify usable service information and the location of relevant assets. A Pakistani order and recovery abroad can involve different legal procedures. Overseas residence alone does not establish either automatic recovery or permanent immunity from enforcement.

Keep copies of every order, application, service report and receipt. Ask for a written case update after each hearing, including the next date and action required. This record helps prevent missed directions and avoids repeated disputes over amounts already received.

Frequently Asked Questions

What Is a Maintenance Execution Application?

It asks the competent court to enforce an existing enforceable maintenance obligation. The application should identify the order, unpaid amounts and the lawful relief sought.

Can I Recover Arrears Without a Court Order?

A private demand or agreement may require a different legal route. Counsel should first determine whether an enforceable order exists and what proceedings are necessary.

How Should I Calculate Arrears?

Use a month-by-month ledger based on the operative order. Deduct proved payments and separately identify any additional expense or increase authorised by the order.

Can School and Medical Costs Be Added Automatically?

Do not assume every expense is included. Check the order’s wording and whether a further determination or variation is needed for additional amounts.

Does Filing an Appeal Automatically Cancel Payment?

Check the actual appellate and stay orders. Do not assume that the mere existence of an appeal eliminates an operative payment obligation.

Can Salary or Assets Be Recovered Against?

Available measures depend on the applicable law, evidence and court directions. No attachment or salary-related order can be guaranteed in advance.

What If the Payer Claims Cash Payments?

Provide the court with receipts, banking evidence and relevant communications. Identify disputed amounts clearly so the court can assess the competing accounts.

Can Future Instalments Be Tracked During Execution?

Yes, maintain a current ledger. Ask counsel how additional accrued amounts should be presented in the existing matter under local procedure.

Can I Increase Maintenance Through the Arrears Schedule?

The schedule should implement the operative order. A request for a higher amount may require a separate enhancement or variation procedure.

What If the Other Parent Lives Abroad?

Review service arrangements, assets and any overseas enforcement route. Residence abroad does not by itself determine whether recovery is available.

Can the Parties Agree on Instalments?

A proposed arrangement should specify arrears, current payments and default terms. Obtain advice on recording it properly and protecting the child’s interests.

How Long Will Recovery Take?

Timing depends on service, objections, court scheduling, assets and compliance. A filing date does not support a guaranteed recovery deadline.
